That pesky Constitution again. The religious right would like to retool the parts, as long as it suits their world view. Rights for all is a real sticky point for them.

Passing an amendment to the US Constitution is logistically impossible. You need 2/3’s majorities in both houses of Congress and in 3/4’s of the states. Opinions on gay marriage are pretty regional so this will never happen.

Gay marriage isn’t an issue I would go into the ring over, but I can’t favor it. It’s hard to see a federal marriage amendment passing in the near future, but the real question is why you would need a three-fourths majority to stop judges from overriding settled law with novel interpretations of the Constitution. I don’t think we need a federal marriage amendment; I think judges just have too much power.

It’s not “settled law” since it got thrown out under judicial review. Perhaps you should educate yourself on how our system of government works before you start this “judges have too much power” bullshit. The decision this is based on was in 1806 and we are a Republic not a straight democracy. If you don’t support it then you don’t support or even understand how our country works.

The Constitution allows Congress to exempt specific topics from judicial review, which has actually been done in the case of no-knock drug searches and construction of the Alaska pipeline. So since Repubs controlled Congress from 1994 to 2006, why didn’t they deal with gay marriage that way? Or for that matter, abortion? Because those issues keep the far right base reliably stirred up and ready to vote, mayhap?
