Who Should Rule on Prop 8?
Tony Perkins (head of the family research council) wants everyone to know that Judge Walker is gay and shouldn’t be ruling on the issue. Of course, this is only a rumor, and one most likely started by the far right as the beginning of a slander campaign.
But this brings up the question: Who should rule?
The right has labeled this as a “marriage and family values” issue, so anyone who is married, or has a family, should be excluded from ruling. The right has also framed this as a “procreation” issue (it isn’t – condoms, birth control, pulling out, and countless other procreation-control devices aren’t illegal). If they want it to be about procreation, then anyone who has ever been born should be excluded because of bias.
But I don’t really think anyone needs to rule on this. This is a human rights issue - the universal truth is that homosexuals are the same as heterosexuals, and should be granted the same rights. That shouldn’t be up for debate.
If human rights were up to voters interracial couples would not be allowed to marry and slavery would be legal. There are certain standards that cannot be crossed. This is one of them. It’s a universal, undeniable standard – no judge needed.
