German Higher Regional Court Judge sues President of Federal Criminal Police over US Drone Attacks in Pakistan

“In the case of the German Islamist Bünyamin E. killed by a US drone, the German federal government is getting under pressure. Thomas Schulte-Kellinghaus, judge at the Higher Regional Court Karlsruhe, has filed a criminal charge against the president of the Federal Criminal Police Office, Jörg Ziercke. Responsible authorities from the Offices for the Protection of the Constitution [domestic intelligence federal and state agencies] and the Bundesnachrichtendienst [foreign intelligence federal agency] might possibly also be suspect of having been accessories to the murder of Bünyamin E. The criminal charge is supposed to help bring to light whether German intelligence offices, prior to the drone attack, have been passing on information to the United States effectively leading to the deadly strike. On October 4th, a house in the Pakistani city Mir Ali used by Islamists had been shot at by the Americans (SPIEGEL 41/2010). Responding to questions from The-Left-MP Wolfgang Nešković regarding involvement of “German authorities” the responsible Secretary of State of the Interior Klaus-Dieter Fritsche so far has only given vague answers: From “criminal procedural measures” no information is supposed to have been given to the USA. He did not say anything about possible other findings. “The elusive answer and the current state of evidence do not allow any other conclusion than that information by intelligence agencies has been given to the US-american side”, speculated Nešković, himself a former judge at the Federal Court of Justice of Germany.”
