Thanks for posting this. I heard a fragment on NPR this morning that wasn't even enough to google from.

Their base they pander to is so braindead the thought of Snopes gives them the pox. You wouldn't expect them to figure out the facts for themselves, would you?

This fallacy of taxpayer funded abortions has gone around so many times it's accepted as fact now. But if it gets people pissed off and moms dragging their kids to pro-life rallies, they consider it mission accomplished. It makes a nice bookend to their Welfare Queen outrage.

And in light of all their "facts," they're still anti birth control as a bloc. I guess with fewer unplanned babies being born, especially to Welfare Queens, they couldn't maintain the same level of perpetual outrage. That's where they prefer to dwell; screw the moms and the kids they were forced to bear.

Are you sure they're factually wrong from every possible interpretation?

As I read it, they said that the guy voted for a bill that provided taxpayer funding for "abortions". Does that mean it provided taxpayer funding for all abortions, or just some?

Is it possible, under the bill, for an abortion of an incestuously conceived fetus to be funded? Then the bill "funds abortions", at least from one perspective. If the bill cannot possibly have lead to public funds going to pay for any abortion, even one that was necessary to save the life of the mother, then yeah, they lied. But is that really how things stand?

In campaign mode, politicians lie all the time. And everybody presents their case in stark black and white, or in bold primary colors, rather than get into the nuances. That's politics.

You can't sue people for lying about the content of a bill when the truth of the matter hangs on interpretations of the meaning of a phrase, and opinions differ on what it means or how the courts might interpret it.

Is it going to be illegal to say that Obama ran up the deficit, because in the opinion of some judge, it was forces beyond his control that led to the runup?

I'll grant that even politicians have legal recourse against campaign literature that says they bayonet babies for weekend fun. [Though leftist anti-war literature from the Vietnam war said things in that vein about LJB without legal consequences]. But when it comes to matters of opinion, it can't be illegal to hold an opinion different from that of a judge, or the candidate, on some matter of public policy, and to speak and write as if your own opinion is the right one.

Lying is protected speech, but lying about a specific person with malice is not necessarily protected.

BTW, I don't think Driehaus has a chance in hell of winning. As the article admits, ACA preserves the status quo, and the status quo allows federal funding of abortion under certain circumstances. The fact that other conservative Dems refused to vote for the bill due to this is indisputable. And even those Dems who voted for it only did so after Obama issued an executive order affirming the Hyde Amendment - this executive order isn't part of ACA, so the fact that it was issued at all gives SBA cover.

SBA countered that they believed the claim to be true, or at least "protected opinion," and argued that there had been no malice.

They didn't mean malice? Bullshit. Seriously screw the political pro life movement. I understand why abortion is unpopular but these people are slimy assholes.
