Rick Santorum already refers to pregnancy via rape as a "gift from god" so it's only natural that the rapist is also a "gift from god" and the two should be married.

Moroccan penal code exempts a rapist from punishment if he agrees to marry his victim.

This is culture, not Islam, though clearly most Moroccans are Muslim. I've heard of the same practice in other Muslim countries where there is no such law on the books. It is (obviously) a brutal, disgusting, and unjust law. In 20+ years of practicing and learning about Islam I have never encountered anything that would support or condone such a law.

Seeing how far-right fundamentalists in the U.S. are currently twisting Christian ideas, and witnessing recent events with extreme fundamentalists in Israel, I guess I have to say I'm really not that surprised that such things exist.

Of all the bad and sad things I've read today, this story breaks my heart. That poor, poor girl. No chances, no hope, repeatedly violated. Disgusting.

CL, here's the deal: If it happens in Indonesia and the Muslim parts of Bosnia and the Philippines as well, than it's a Muslim custom.

Otherwise, it's the local culture, not the religion.

The problem here is a culture in which rape is a crime against the family's honor, not the girl.

It's like FGM. It's a cultural practice that some Christians and Jews (Ethiopian) do/did too in those areas, but as the population is predominantly Muslim, the customs are often described as Islamic, and they seep into the religious customary law.

Exactly. It's disheartening, depressing—not just that these horrible practices seep into customary religious law, but that they exist at all. I can't begin to tell you how thankful I am that I was born in the latter half of the 20th century in America. When I think about what women have suffered in the past, and what many are still suffering... *shudder*

No, sir! He's made clear he doesn't believe that. He has clearly stated that rapists should be arrested, tried, and if convicted imprisoned.

Go after a man for what he says and does, don't make up shit like this.

Yeah, Dinah, Jacob's daughter was married off to the prince of Shekam that raped her. Her older brothers, to their credit, were having none of it and killed him later.

Of course, exactly what is going on in that passage is infinitely interpretable. There's one line of thought that suggests that the story is actually about a no-longer-extant tribe, tracing its descent from Dinah, which was destroyed by Shechem.

This custom is clearly cognate to the passage quoted above, however. It's a 'you break it, you bought it' approach to rape. However, the situation above would have been prohibited in Rabbinic Judaism. The Gemara clarifies that the rapist is obligated to marry his victim if she agrees, (and may not subsequently divorce her) however the woman is under no obligation to accept this arrangement.

None of which helps this poor kid. What a hideous mess.
