Grassley may be a racist, but I think I would also have to object to the idea of special judicial systems co-existing for citizens in this country.

It may sound harsh, but I do think that one of the consequences of our history is that the Constitution still takes supremacy over any sub-set of jurisdiction - whether that be “States” as in the 50, or “nations” as in the semi-self-governed Native American tribal system.

Of course, Native Americans and African Americans did very well when tried by all white juries I’m sure. I wonder what Grassley’s view of that would be.

So, if we arrest an undocumented person, we need to have a trial in their country? Or maybe have a jury of undocumented person?

…oh, in that case its fine to have 12 white dudes decide the case.

Trouble is that if some non-Native American marries a Native American woman and lives on the Reservation, if he abuses her the Feds are supposed to handle it. Problem is that the Federal government has a lot of higher priorities so nothing ever gets done about it.
In what practical way is a tribal jury different from state or local juries? Or should all domestic violence cases be handled at the Federal level?

This would be the argument —no?

A precedence would be set and another chink would (theoretically) be cut into States Rights. Which, would make sense if States were given the jurisdiction in the first place, but these women have NO place to go.
