I agree with Davis, although her argument that she lacks the manpower to adhere to these regulations is disengnous. Software can take care of the multitude of tax districts issue.

But, she is fundamentally right. As a California company, she receives no benefits by paying Florida taxes. As a matter of fundamental fairness, she should not be required to become an indentured agent of Florida.

Nor should Florida, which provides no benefit to a California company, subject a California company to pay taxes without representation. Florida voters get to vote on their tax rate, California voters do not get to vote on Florida tax rates.

There is only one flaw in her argument. She doesn‘t have to pay FL taxes.

If she wants to compete with businesses in FL that do have to pay FL taxes by shipping to FL instead of selling goods only in CA (the only place where she and her customers are both “represented”) then it seems only fair that she should also have to pay taxes in FL.

No I am not a tax cheat. The purchase was made outside of State
boundaries. If the State where the vendor is located in wants to tax said purchase, so be it. But if they don’t, again, so be it.

The Internet tax is just another method politicians want to use to stick their hands in your pocket book to scape every penny they can from you.

You are looking at “fairness” in a one-dimensional basis, How is it fair that Florida businesses receives government services that she is denied? Will she be able to get Florida tax incentives like a Florida business would? Is she able to vote on Florida taxes? Sales taxes is not an issue of “fairness”, it is an issue of tax revenues. Those tax revenues are spent on Florida citizens for Florida citizens. Imagine if she was required to get a business permit in every jurisdiction she does business with? After all, is it “fair” that a Florida business needs a business permit to do business in Florida, but she “skirts” the law?

No one is forcing her to sell in FL. If she thinks that paying FL taxes deprives her of representation and the benefits of those taxes, she can refrain from selling there.

Her claim that she has a right to sell to FL without obeying their tax laws displays a surprising sense of entitlement for a business person.

Just as she has a right to sell in Florida without a valid Florida business permit. How is a sales tax any different than a business permit?

She is not obeying Florida tax laws because she is not an agent of the Florida Department of Revenue nor should she be required to be an agent.

So you are going on record as stating that any online retailer that sells in any municipality other than their own should maintain a valid business permit in each jurisdiction that they sell a good or service to?
