But we will, and we’ll make sure they understand that if they want to pass through the District of Columbia with loaded firearms as long as they are in compliance with the firearms laws for transportation of firearms to the District, we’re all for it. But passing into the District of Columbia with firearms is a violation of the law and we’ll have to treat it as such.

Huh? What does that even mean? This is another credibility race to the bottom, not sure who wins here. After all DC was the source of the one anti gun law so egregious it compelled the Supreme Court to finally after decades of reluctance uphold (IMO) an obviously individual right. I guess I’ll have to dig into DC code and see if there is any legal way to enter DC with a loaded gun. i doubt it very much.

As to the gun advocates-Again IMO-Stop this foolishness now. There are far better ways to get this done. More helpful and more persuasive. No guns required for that at all.

Open and concealed carry are both illegal in Washington DC, you can transport an unloaded weapon to a range or keep one in your home for self defense.

Walking down the street with a loaded assault rifle is right out.

If I am reading it right she is pointing out that there is a difference between passing through the District with a loaded firearm (legal if certain Laws are followed) and bringing a loaded firearm into District for the purpose of a demonstration which is illegal.

I look forward the the ravings of these nuts after they’re arrested, fined, and maybe jailed.

If there is no legal way to have a loaded gun in public (as in maybe a locked case?) then the police man Chief(!) picked a very strange turn of phrase. If there is a legal way, perhaps as I mentioned, then that should be openly declared up front by the police. This way or else, and we’d rather you held a protest without any guns.

Most right wing gun nuts I know believe the 2nd Amendment effectively allows open carry anywhere and everywhere. That would of course be the “bear arms” part of the equation.

I imagine these protesters feel the same and would throw a big fuss about violation of rights if DC police arrest them.

If there is no legal way to have a loaded gun in public (as in maybe a locked case?) then the police man Chief(!) picked a very strange turn of phrase.

Here’s the relevant section of DC law:

§ 22-4504.02. Lawful transportation of firearms.

(a) Any person who is not otherwise prohibited by the law from transporting, shipping, or receiving a firearm shall be permitted to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry the firearm [see § 22-4504.01, above] to any other place where he may lawfully possess and carry the firearm if the firearm is transported in accordance with this section.

(b) (1) If the transportation of the firearm is by a vehicle, the firearm shall be unloaded, and neither the firearm nor any ammunition being transported shall be readily accessible or directly accessible from the passenger compartment of the transporting vehicle.

(2) If the transporting vehicle does not have a compartment separate from the driver’s compartment, the firearm or ammunition shall be contained in a locked container other than the glove compartment or console, and the firearm shall be unloaded.

(c) If the transportation of the firearm is in a manner other than in a vehicle, the firearm shall be:

(1) Unloaded;
(2) Inside a locked container; and
(3) Separate from any ammunition.

So, unless you’re a cop there’s no way to legally carry a loaded weapon into DC, either in a vehicle on your person - not even if it’s kept in a padlocked hardcase nested inside two more nested padlocked hardcases. Yes, strictly speaking the Chief spoke incorrectly, but his intent was obviously to address the specific situation he was being presented with, and he wanted to make clear that there was no way to openly carry a gun, and no way at all to carry one that’s loaded.

Interesting glitch. The edit function appears to hate the “section” symbol -§.

Test- LGF code will allow you to post a comment containing the symbol normally, but it and everything after it will disappear in the editing screen.

Mistake? Enticement more like.
Why the heck not just say there is no legal loaded possession except at the range? (If there even is a public range in DC) What she says is damn near entrapment. “Okay as long as you obey the law,….

How sadly typical of the policing at the most (at least top two) egregious jurisdictions. A jurisdiction that has learned nothing from the Supreme court except how to grudgingly appear to obey pending further case law.

I think you’re reading too much into it. She spoke off the cuff and accidentally reversed the two scenarios, she should have moved the term loaded to the last sentence. Yes it’s her job to know this kind of thing but I very much doubt that the flub was intentional or that there was any attempt to entrap since her statement regarding loaded firearms was specifically limited to travel through the District, which in any instance would not apply to the protest march.

13 EiMitch  Thu, May 9, 2013 4:45:48pm
Obviously there has been no permit filed by the organizer

This protest march is illegal, loaded guns or not. Neither the first nor second amendments exempts protestors from filing permits for public gatherings.

I hope nobody gets hurt when the cops bust these dumb f***s. And dammit the cops are going to bust them. Prepare that popcorn in a sound-proof booth so some panicky idiot doesn’t get the wrong idea.

For the record, MPDC Chief Cathy Lanier is a “she”, not a “he”.

15 HappyWarrior  Fri, May 10, 2013 5:27:01am

Doesn’t help that Adam Kokesh has been acting like a jackass on Twitter. I’ll ask it again, what genius plans on having a concealed carry rally in DC on the day that city is going to be the most crowded it is all year?

16 Romantic Heretic  Fri, May 10, 2013 7:04:32am

Oh, this is going to end well. //

Just imagine if this was planned by a minority group of brown people. The teahadists would label this as a “terrorist march”.
