The 2001 U.S. Patriot Act allows the FBI to seek an order to obtain “any tangible thing,” including business records, to gather intelligence.

Obama Administration Defends Its Right Take All Your Phone Records
By Dashiell Bennett | The Atlantic Wire

The administration has responded to the Guardian’s report. The commentary seems to be mainly pro-gun and anti-Obama ranting.

My own opinion is that for most of us, there can no longer be any expectation of privacy for even the content of voice communications, because a-d and d-a converters are now dirt cheap, as are bandwidth on the internet, and digital storage.

Our wiretap laws have traditionally supported privacy of our conversations (and faxes) only for purely analog endpoint-to-endpoint connections —which very few of us have anymore. Even when it’s still analog on both ends, intermediate parts of most modern voice connections are rapidly going all-digital, for exploiting VOIP and related technologies. So for much of those intermediate parts, some different law(s) may apply, or no law.

If some hacker does that, he does break the law. Also he has no connection to power. He is not part of the government. And that is why Google only annoys me and the NSA gives me the civil protection creeps.

When GWB started/signed this after 9/11 it had a far more limited scope-just terror, just offshore. The danger was far more imminent or at least thought to be. When will the sun fail to set? As soon as it is attached to the Patriot act sunset clause. The clause that never happens. I’ll probably meet the real Santa Clause before that happens despite claims to the contrary.

Every day is a day that our sitting President campaigned on a strong respect civil liberties and has not found this worthy of serious attention. This is a wart on President Obama & the Democrats reputation. A big one.
