No matter what you think, or your friends think. Engaging in sexual activity with an intoxicated person is a crime. The Crime of Rape.

Then I guess both my husband and I are rapists cuz we often get it on after drinking more than we should. And what was that that we smoked?

Don’t get me wrong. Rape is a serious problem in our society, so all the more reason to define it carefully. Extreme definitions don’t help the cause.

First let me prepare myself emotionally to get down-dings.

OK, I also happen to agree with Emily Yoffe that women can, through their own agency, help protect themselves and lower the rate of rape. Many cry, “You’re blaming the victim,” but the way I see it, giving women facts about keeping themselves safer is empowering them. Cautioning women that some predators may slip drugs into their drinks can help them know what to be on the lookout for and that they need to stay alert enough to keep track of their glass.

Do I think that drunken coeds or teens deserve to get raped? Of course not! I don’t think that a person who fails to look carefully both ways before crossing the street deserves to get hit by a car, but I think we all know it is important to teach our kids how to cross the street.

Yes, I think that boys and young men need to be taught not to rape women and that the winking acceptability of rape in many circles needs to be expunged, and rapists need to be prosecuted. The fact that a rape victim was drunk should never be seen as a mitigating factor for the perp. But in the meanwhile women need to be especially careful. Sure, it is not fair that women need to be more careful about binge drinking than guys, but hell, it is not fair that men have higher metabolisms and can eat more. Biology is biology.

Women typically weigh less, get drunker on less alcohol, and are not as physically strong as guys. Young men are also experiencing their peak sexual drives years before women catch up. All these factors coupled with the realities that sex can result in a woman getting pregnant and that STD’s spread most often from male to female make it imperative that women be extra cautious.

BTW, I think that guys should also be cautioned about binge drinking———after all, if they are really drunk they might fail to recognize that what they are doing could qualify as rape.

In a court of law, an intoxicated person cannot give consent.

It is not about what you or I think people should or should do. If you and your husband become intoxicated with the intention of engaging in sexual activity, one could argue it is consensual. I don’t think a judge would bother to hear the case unless one of you ended-up in the hospital.

This is about crime. Serious crime with serious repercussions.

Not necessarily since if the ‘sexual activity’ was only grabbing someone’s breasts it would be a sexual assault, not rape.

And except for when it is consensual———or that is, when the parties have agreed before becoming intoxicated. Again, I feel like the definition still needs refining; just how much does one have to have consumed before they become unable to give consent? This is an important point since many sexually inexperienced (young) people are nervous and eager to avail themselves of a drink or two to loosen up.

But as I said before, the drunkenness of a rape victim should never be considered a mitigating factor reducing the culpability of a rapist. It is a horrible state of affairs that juries too often do harden their hearts against drunken victims. That surely send the wrong message.
