My first reaction, having read her Google+ post and replies, was that this woman and her supporters are entitled nuts who think that by virtue of being ultra-geeky the rules don’t apply to them.

Of course you can’t strap displays to your head while driving. That’s not unclear at all. If you’re not allowed to watch TV while driving, you’re not allowed to do it by virtue of a head-mounted display, and there’s no way the cops can tell at all what you’re doing on an HMD.

She just keeps spinning stories to try to pretend that she wasn’t totally out of line.

Try to keep in mind Google glass is no more distracting than a heads up display in the car glass. Less so than navigating via smartphone screen. It’s about content as per the law. Navigation is specifically allowed. So if she was using a navigator or Waze or some similar app this can and should be tossed. If she was reading email it’s a righteous violation.

Irrelevant since it’s not regulated like a heads up display in a car, and dinking around with your phone while driving isn’t OK either.

It’s about content as per the law. Navigation is specifically allowed. So if she was using a navigator or Waze or some similar app this can and should be tossed. If she was reading email it’s a righteous violation.

Do you have a citation regarding this? I’ve seen nothing indicating that an exception has been made allowing using HMDs in a car if it’s for navigation. From all I’ve read, it’s completely illegal to use Google Glass while driving in California.

Dash/window mounted GPS receivers lock out some functionality when moving, because the exception allowing the driver to look at a GPS screen while driving comes with regulations as to functionality to reduce danger, If and only if Google Glass has this functionality and has been certified does she have a defense against this.

At some point I could see the law changing if this becomes a commercial product and locks into a car mode while driving, but I’m pretty sure that at this point what she did was very illegal and the cop was right to be incredulous and angry that anyone smart enough to be interested in Google Glass dev kits was stupid enough to think it’s OK to have it on her head in the car.

Of course as the Aaron Schwartz case taught us very smart people can be totally clueless as to how society and laws work.

GPS device permitted for use in windshield.

A cell phone in GPS mode should be just as legal, court decisions may not agree.
