The two most active have histories of 2 and 3. Looks like sham bidding to me, but who knows? Someone like Sheldon Adelson might think having the work of a murderer on display would be a draw to his casinos.

Zimmerman Copy Painting

According to further info on the ebay auction page, he did it latex house paint. Why do I have a feeling that the process was something like this…

1. Take copyrighted stock image
2. Put some text on it in Photoshop (or paint for that)
3. Get printed on canvas at WalMart.
4. Paint over it at home.
5. Sell on Ebay.

He did do a nice job of pretty much staying in the lines. The wager I made earlier still stands, if this auction actually closes and he gets paid 99k or more, I’ll dance a polka with a pig on the LFG Stage.

This reminds me of the celebrity status afforded war criminal William Calley 40 years ago. A fawning ballad in support of Calley was a number one pop music hit. Georgia governor Jimmy Carter (yes, THAT Jimmy Carter) asked citizens to drive with their lights on to express support for Calley. Calley’s wedding to the daughter of a prominent Atlanta jeweler was the social event of the season. The Army sentenced Calley to life at hard labor, but a firestorm of protest led to his being released after just 3 and a half years of house arrest in his quarters at Fort Benning.

The more I look at it, the more I think that he used a download of the catalog image with the ‘shutterstock’ logo over it. there are some lines and shading that correspond to where parts of the logo would be, but I’m not 100% positive.

This may get interesting.

He didn’t have to work that hard. Skip step 4 completely (nice lettering for house paint). He probably did paint his name on it, but that’s about it.

As far as wingnuts’ Photoshop efforts go, as a whole, I’ve thrown better shit away in my recycle bin.

I suppose I could set up a side effort of throwing together as many dog whistle elements as I could find, add some really stupid fonts, hit frappe, and make a fortune exploiting the shit out of their jingoism and paranoia. Sadly, I can’t bring myself to do it.

It appears that representing a Shutterstock image as your own, even if modified, without giving attribution to Shutterstock is a copyright violation. Selling it is even worse.

I wonder what will happen if someone reports this to Shutterstock?

I guess we’ll find out soon.

BINGO! And, I’m not sure if attribution would be sufficient if he’s trying to sell it for profit without having a Shutterstock license.

Edit: From their FAQ:

If I modify an image, can I claim copyright to that image?
You may modify an image and use it; however, you may not claim copyright to that image. Shutterstock and/or its suppliers continue to own all images, whether or not they have been modified.

Can I sell the images that I download?
You may not sell the images that you download from Shutterstock. You can use them in design elements, but not offer them for resale or distribution.

You can’t do it even with a license if you don’t give attribution to the original artist/Shutterstock. It’s all right there on the Shutterstock page.

Yes. I agreed with you and provided further documentation that Killermann violated their TOS if indeed he used their photo. The attribution, whether provided or not, is irrelevant since he’s trying to sell a photo that doesn’t belong to him. Moreover, he modified an existing photo which is a violation of their TOS. Wow….bolding is so much fun,

I guess if you just download the thumbnail you might not notice that.

and when I looked at the thumbnails on their site there are some places where lines in their watermark match very nicely up to some of the lines in the image. He may have not even have gotten the license to the image, but simply used the copyright marked thumb. That’s just speculation on my part, I’m not going to go pixel peeping on this.

Oh, it’s also at 110,100 right now.
