No, it was just cops thinking they can do what they want as long in getting rid of a meth lab.

Given the dangers of the production and use of crystal meth, the ends of the police in this case were just, but the means used to achieve those ends were in my mind unconstitutional.

There was an episode of Star Trek where a character was arrested because his future self committed crimes that wouldn’t actually occur for another 15 years.

The arresting officer said: “I’m placing you under arrest for crimes you’re going to commit.”

This is really about the police not following procedures, not “future crime”. The perp was convicted of “intent to manufacture”, not actually manufacturing. So “fixing to” cook meth is actually illegal.

I don’t understand why the dissenting judge (Meyers) felt that a CI’s information about someone “fixing to” commit a serious crime isn’t enough for a warrant. An anonymous tip, yes, but shouldn’t a CI have more weight than that?

I’m not sure it should, given what we know about the history of abuse by police of the confidential informant system.
