Among other things, this filthy excuse for a bill would seem to provide full legal support for those who want to keep the races pure by oppressing interracial couples.

I’m not prepared to believe that is an unintended consequence of this bill

I’m going to repeat what I said in a previous page about this bill. Calling this a “Jim Crow” style bill is entirely accurate, for more than the reason stated in the article.

Take note that the wording doesn’t specifically name same-sex marriage (in fact, same-sex unions are even mentioned only once), but is much broader by stating that ANY marriage/union is subject to their religious approval.

In other words, this statute gives tacit approval for miscegenation-related discrimination, the Loving v Virginia Supreme Court decision be damned. The reason I say this is because Loving v Virginia only stated that mixed-race marriages were legal (ie states and locales could not prosecute as a criminal act). It. in itself did not offer protection against discrimination.

This needs to be struck down and it needs to be struck down hard. This needs to go all the way to the supreme court. This just makes me even glad we don’t have the stupid Plessy v. Ferguson court any more. The people in the Kansas Legislator who supported this ought to be ashamed of themselves.

Hopefully one of its major backers be stupid enough than to try to argue that old “separate but equal” nonsense that the court rejected in Brown VS Board of Education. Obviously if this does make it to the supreme court, and hopefully it will, the plaintiff’s lawyer will be smart enough to bring up how similar it is to Jim Crow. Although Jim Crow was even worse, since under Jim Crow you were required to discriminate by law.
