Yeah, what’s wrong with keeping the door closed and calling 911? This is a no-brainer.

Facebook friends as grounds for recusal… that might be the most desperate thing I’ve ever heard of a defense attorney attempting.

The judge is never gonna let any of that in. Sorry, but murder victims don’t get dragged through the dirt in legal proceedings on fishing expeditions.

“Your honor, defense wishes to introduce some pictures of the deceased with marijuana, along with a picture of what might be her with a gun, and some tweets where she apparently said some aggressive things.”

“Irrelevant, inflammatory, and prejudicial. Next.”

The defense is desperate, because the stuff they’re trying to introduce won’t get in for the same reason the judge in the Zimmerman case excluded a number of videos and photos of Trayvon Martin:

1. They were inflammatory and prejudicial, as Steve Davis noted.

2. In neither case did the defendant have any way of knowing about the deceased character. A defense of “Justified Self-Defense” revolves around the question of if the defendant’s actions were those of a ‘reasonable and prudent person, knowing what the defendant knew, in the same situation. If the defendant knew nothing about the deceased, then any past photos or video are normally out.

McBride is most likely going up the river, and this sort of desperate tactic is evidence of that likelihood.
