It’s bad enough that he’s out on bail, but the fact that he is also on paid leave still is just stupefying.

I don’t know. Compared the the killer of Michael Brown, this guy is serving time on Devil’s Island, and he doesn’t even have a $500,000+ defense fund yet.

Funny laws we have in this country. Walking in the street is worth a death sentence, raping eight women gets you administrative leave with pay. I wonder if Chief Justice Roberts has noticed that his claim of a post-racial America is completely full of shit?

IMHO, murder (and it’s many variations) and sexual assault need to be federal crimes. Justice in this country is not consistent with these most heinous of crimes.

What’s the problem with bail? It’s part of that whole “innocent until proven guilty” thing. He’s under house arrest, I assume he has an ankle bracelet and his acts were committed under color of law. As far as the paid leave, that’s what happens when you have a good union, c’est la vie.

Bail is supposed to be set not as a penalty but as a means to secure the defendant’s cooperation to appear in court or else forfeit the bond.

The problem isn’t that he had $500,000 bail set, but that he had bail at all.

The kind of crime he is alleged to have committed - 8 rapes - doesn’t justify bail in my book. That’s 8 counts of rape, each of which is punishable by up to life or life without parole. The seriousness of the crime, coupled with the number, and that it is a police officer would suggest bail is inappropriate while he awaits trial.

That’d be 21-1115, which appears to set a minimum of 5 years and a maximum of life without parole.

It’s not 8 counts of rape, not sure where you’re getting that from. Generally speaking, it’s a matter of whether there is evidence that he’s a flight risk and the likelihood that he will reoffend. I’m not saying he shouldn’t have gotten bail or not, just that it’s not surprising. I doubt he will go on a raping spree while he’s out on bail, more likely he will kill himself.

Neither of the articles specifically mentioned 8 counts of rape, but both mentioned him having been charged with sexually assaulting 8 black women.

From the first article, emphasis mine:

Daniel Holtzclaw was formally arraigned last week on several counts of sexual assault, including first-degree rape, forcible oral sodomy, sexual battery, indecent exposure, first-degree rape by instrumentation, first-degree burglary and felonious stalking. His alleged victims were all between 34 and 58 years old.

Sounds like a real prince. I can’t imagine why anyone would be upset about it or think he might be a flight risk or a danger to anyone. //

Actually, bail includes flight risk, the threat to the community, and the ability of the person to pay.

This person is alleged to have sexually assaulted and/or raped eight women.

There are lesser included charges involved for the sexual assaults. All told, this guy is looking at up to life in prison - for just a single count of first degree rape in Oklahoma. And the articles all indicate that there’s at least one count of first degree rape involved.

That puts his risk to the community on the high end. Bail in my view is not warranted under the circumstances especially since he’s a cop who already appeared to have violated the public trust by committing these crimes even though he is a cop.

I’m an attorney, although the criminal matters I handle are minor. I don’t see the defendant as a risk to the community because his acts were committed on the job or he identified his victims on the job. I don’t see him hunting for new victims now that he is under house arrest and can no longer target woman that he comes across while working as a police officer. I just don’t see it. I see him putting a gun in his mouth or leaving the car running with the garage door closed. The odds are that is what is going to happen. Bookmark this thread. :)
