Why is this not the Department Of Justice acting? ACLU? Nice but really the Feds must be sleeping on the job.

Perhaps.

On the other hand I suspect Mississippi is regarded as a powder keg by the Feds. If they aren’t really careful with their power those people being held might become lynching statistics instead, or suffer ‘shot while escaping’ incidents.

ACLU will just piss off the racists. The Feds will inspire them to murder.

I don’t think it’s removed from that past at all. It just hid it for a while, until the GOP decided it would be a good get out the racist vote technique.

In a Mississippi Jail, Convictions and Counsel Appear Optional

They have a short interview with one of the judges in the county who gives his justification for not granting counsel:

In a brief interview, Judge Gordon said it was indeed his policy to appoint indigent defense only at indictment, even though he might approve a defendant’s request for counsel long before that.

“The reason is, that public defender would go out and spend his time and money and cost the county money in investigating the matter,” Judge Gordon said. “And then sometimes, the defendant is not indicted by the grand jury. So I wait until he’s been indicted.”

As for how many people are sitting in the county jail without being charged? Almost half of them.

According to Brandon Buskey, a lawyer with the A.C.L.U.’s Criminal Law Reform Project, 53 of the 129 inmates in the Scott County Detention Center have not been indicted.

Just read about this, this morning. This is some pretty effed up shinola.

Judge Gordon then said that he did not have the jurisdiction to appoint a public defender at all until a defendant was indicted in his courtroom, even if someone were to request a preliminary hearing or a bail hearing. In those cases, the judge said, a defendant “can represent himself, or he can employ an attorney.”

I don’t think cowardice is the problem.

I don’t believe such behaviour as I outlined is cowardice any more than handling an IED with care is cowardice.

DOJ needs to get involved with this. This is exactly why it’s important for Obama and his advisers to choose a quality AG to replace Holder. This shit is wrong.
