Good for her for speaking out. I unfortunately totally expect the same reaction to her that Emma Stone got.

“Crime” has two meanings. One is something that’s just so wrong it outrages our moral sense. The other is something that’s on the books, written down, specifically outlawed.

The question of whether leaking nude photos is a sex crime in the second meaning of the term hangs on what statutes have been enacted, and does not depend on how we feel about it.

Except if we care, we can get new laws enacted to cover this if it’s not already covered.

And that’s not even touching the whole hacking aspect, which is also has laws on the books against it.

I find little to take issue with in this law….

Although Arizona’s law is particularly draconian, Rowland says any law that criminalizes revenge porn is actually problematic.

“As a general matter, we don’t criminalize gossip or other truthful but embarrassing information about people that we have relationships with,” Rowland told WIRED. “Revenge porn does create acute harm for its victims, who are predominantly women, and I think it’s valuable for lawmakers to have a conversation about how to offer victims of revenge porn relief. But there are many solutions, including civil law, that don’t create an acute chill on protected speech like Arizona’s law does.”

I didn’t realize that gossip and distributing nude photos of someone to embarrass them was the same thing. Silly fucking me.

…Except this, which I see as problematic, because in my eyes, this should be federal law, not state-by-state because what can AZ do if neither person is in AZ? …

The law does not establish when Arizona has jurisdiction to prosecute—for example, whether the person depicted in the image must be an Arizona citizen, whether the image was shared or published by someone who lives in Arizona or whether it’s enough that an image was published on a web site that was viewed by residents of Arizona.

… and this which would be a bigger concern, because it is ridiculous and the whole judicial system often gets ridiculous …

And it’s not farfetched to think that Arizona authorities would wield the law in a broad manner.

In 2008, authorities in Maricopa County, Arizona, considered launching a child porn investigation into the Phoenix New Times and its publisher for posting a series of images taken by Arizona artist and university professor Betsy Schneider of her own children. The images, from an exhibition of her work, included depictions of her naked children when they were infants. A Phoenix city attorney said at the time that if the photos were found to be illegal, “Everybody who picked up one those issues (of the New Times) could be prosecuted for possessing child pornography.”

And to the following, I say…does it matter if someone was harmed or not? If, for example, I send a naked picture of myself to someone, should they be able to share it with anyone they choose without my permission?

The law also doesn’t specifically require that someone have malicious intent in sharing or publishing an image or that a person in the image is actually harmed by sharing the picture. This means, essentially, that “anyone who shares an image, even if their doing so is purely innocent and they have no reason to think the person pictured would object, is the same as a knowing invasion of privacy under the statute,” Rowland said.

Celebrities are people. They should not be made to suffer these indignities just because someone had the ability to hack into a system to get what is not theirs. Those people should be charged with both theft and a sex crime.

It pisses me off so badly that for women, we’re sluts for exhibiting any sort of sexuality - and deserving of whatever they get, where (mostly) men are manly-men when caught with their dicks flying in the breeze.

So I fully expect some RW backlash against Jennifer, and the usual misogynist brigade to do their full dance. That said I recommend that you step back and really think about this issue - e.g. if it were your (sister/mother/friend, or you,) would you think the same way?

And that’s a bad law. A librarian who permits you to check out of the library a book on the Holocaust that includes images of naked, dead victims has broken that law.

The law is overly broad. It’s not so simple to draw a line to where not only is bad conduct prohibited, but conduct that most anybody would think is legal remains legal.
