Wilson wont be penalized for not showing up, but it means that either those criminal cases will have to be dismissed or continuances will be filed to keep those cases from being dismissed.

There have been numerous other documented cases where prosecutors have had to drop cases or even get retrials of previously convicted persons as a result of police officer misconduct.

That could surely happen here as well. Defense attorneys representing anyone who was convicted of crimes based on Wilson’s testimony should be looking at whether any of the evidence was tampered with and other misconduct or inconsistencies based on what is happening here in the Brown shooting case.

I have to disagree a bit here. I do not sympathize with Darren Wilson in any way, but looking at the matter one must remember that anything he were to say in a trial right now could be used against him and that the defense attorney would be gunning for him. At minimum, the fact that he is currently on leave over a bad shooting would be brought up. If he made any notable misstep, the DA would have to present that misstep to the grand jury in the Brown case, however sympathetic the DA might otherwise be.

The risk Wilson would run in testifying would be serious, and his attorney will have advised him accordingly. Moreover, there would be a real risk of him being attacked by someone enraged by his killing of Michael Brown.

You seem to be conceding right there that he is not innocent. It might be wise for him not to testify but it doesn’t make that the action of an innocent man who acted in self-defense.

The law enforcment community in the St. Louis area ought to be able to get him to court safely and get him back into hiding.
