It seems strange to me that someone who is ineligible to own firearms under Federal and many State Laws due to Domestic Violence can be a Judge.

He can still own a firearm, since he was never convicted which is what the federal statute requires:

(33) (B)
(i) A person shall not be considered to have been convicted of such an offense for purposes of this chapter, unless—
(I) the person was represented by counsel in the case, or knowingly and intelligently waived the right to counsel in the case; and
(II) in the case of a prosecution for an offense described in this paragraph for which a person was entitled to a jury trial in the jurisdiction in which the case was tried, either
(aa) the case was tried by a jury, or
(bb) the person knowingly and intelligently waived the right to have the case tried by a jury, by guilty plea or otherwise.
(ii) A person shall not be considered to have been convicted of such an offense for purposes of this chapter if the conviction has been expunged or set aside, or is an offense for which the person has been pardoned or has had civil rights restored (if the law of the applicable jurisdiction provides for the loss of civil rights under such an offense) unless the pardon, expungement, or restoration of civil rights expressly provides that the person may not ship, transport, possess, or receive firearms.

He deserves worse than being hounded into resignation, but he likely won’t suffer worse. Congress doesn’t like impeaching judges, mostly because of the time the Senate has to spend on trying the impeached judge. It can take multiple days, during which the Senate can’t do anything else and during which its members by and large stay in the Senate chamber. That likely means 1-2 legislative days lost, and a day back at home lost, neither of which is something senators want.

I know this sounds like horseshit, and it is. But much of politics is horseshit and the Senate doesn’t like changing its schedule.

As I said above:

Tons of legal cracks large enough to drive a truck thru here.

We must address this. There are too many opportunities for the perpetrators of Domestic Violence (and Sexual Assault) to continue to prey upon the weak.

Doesn’t anyone use spell-check any more?
