At least three out of four liberal justices voted with the majority. When the court arrives at an 8-1 or 9-0 verdict, and you disagree, you ought to at least consider the possibility that they understand the case better than you do.

They’re smarter than you, they’ve given the case more thought than you, and they have talked it over with more people and had more of a chance to weigh other pespectives than you have.

Are you being sarcastic are do you really believe this? Remember Dred Scott? I guess you would just think they are smarter then you so its ok? Our police are completely out of control, and our Supreme Court regularly makes terrible decisions.

They’re smarter than you, they’ve given the case more thought than you, and they have talked it over with more people and had more of a chance to weigh other pespectives than you have.

You sound like a right-wing authoritarian. it’s what people who self-identify as “conservative” almost always turn out to be.

If the end result of this decision is a gutting of the 4th Amendment, well, no; they’re not smarter than KiTA or anyone else. They’re human beings who made a huge fucking mistake, to the detriment of the entire country.

No, seriously. Cops across the country are already behaving as if they’re above the law. The people who are supposed to hold them accountable (Internal affairs, prosecutors) are instead helping them circle the wagons. And now SCotUS just handed them a deus-ex-machina of a loophole through the 4th amendment and pretty much any other law they find inconvenient.

And your reaction is “well, I assume they thought it through. So we’ll be fine.” That is such a lame excuse for complacency.

And as for you SCotUS, well:

This isn’t quite as bad as it seems at first, and I’m someone who sees overreaching by police (civil forfeiture and war on drugs among others) as one of the biggest issues facing the US.

Yes, the initial stop was improper, but cops have always been able to make up some BS about not signalling while changing lanes or similar excuse to pull you over.

The key is that the driver agreed to a search, then wanted the results of the search thrown out because the initial stop was technically improper. NEVER agree to a search. Make the police get a warrant. Had the driver not agreed to a search, this would have gone the other way.

Wrong. Police search cars without a warrant all the time in this country. Don’t kid yourself.

Wrong. Police search cars without a warrant all the time in this country. Don’t kid yourself.

Of course they do, but if you don’t consent then you have a far greater chance of getting the search throw out in court. Once you consent then the game is over.
1) don’t consent to searches.
2) don’t answer any questions a cop asks besides identifying yourself and presenting your license and registration if driving a vehicle.

The cop can still be a dick and call for a dog, and cue the dog to bark, and search against your protests. A cop that goes through that effort wasn’t going to just let you go if you were being nice. But, if you don’t answer questions and don’t consent to a search then the case will likely get tossed.

The guys in these case talked, had conflicting stories, and consented to a search. They made their attorney’s job way more difficult then it needed to be.

I sound like that to you, because you’re so sure you’re right that not even having the overwhelming majority of the best and brightest of your own side differing with you on this means anything to you.

It’s not “right wing authoritarian” to take the view that when one is virtually alone in an opinion, and when people who normally, in your own view, get things right, see the matter differently than you do, then maybe they have a point.

Again, you’re merely leaning on their authority as your sole argument. You aren’t even attempting to explain how or why they’re right beyond reiterating their authority for authority’s sake.

For example, can’t you quote an argument from the majority opinion that you agree with? And maybe elaborate on why you agree with it? That would at least be something. It would be vastly better than “they’re smarter than you. They’re smarter than you. They’re smarter than you. So quit disagreeing already, dammit.”
