I don’t think the expulsions are legally defensible. However, I would guess that the students will likely apply elsewhere and get away from the attention.

Well they are talking about how they’d never admit someone a certain of race to their frat. And I imagine Boren, a Yale trained lawyer and former governor/senator is very knowledgeable of how the 1st amendment applies here.

The behavior agreements students enter into with universities are very different to what they were back in the day. Of course their expulsion is legally defensible.

Moreover, the line “You can hang him from a tree”, also reported as “he can swing from a tree” is a clear lynching threat. Chanting support for the murder of black people is in my opinion a sufficient reason to expel a student.

The counter claim is that it was “clearly a parody” and could not be taken seriously in the context of a bus ride sing along (however disgusting the lyrics).

I’m not sure how you get around 1st Amendment issues since this is a state school.

I would rather the students stayed on campus and be confronted with more and better speech (and a dose of good old fashioned social shaming).
