I was thinking that maybe they did kill her her until I started watching Bland’s YouTube videos. She was a crazy person. She gave the cops a hard time over a traffic stop and ended up in jail with a criminal charge. That’s what happens when you pick a fight over a lane change. Just take the ticket and be on your way. You can fight about it in court. That’s what I do for a living.

There is one video where she talks about suffering from depression. There’s another video where she puts up a sign in the mall and gets in a fight with the mall cop. On another video she puts up a big sign at her table in Starbucks. She was pushing the limit to make a name for herself on YouTube. The woman was unstable. The case should be investigated, but I”m not buying that she was murdered.

This is how morons get locked up over a lane change. Put out the cigarette, you idiot. She could have walked away with a warning, but she chose confrontation and escalation. Maybe she sunk into depression because she thought she was going to lose her job over a criminal charge.

“According to the Texas Department of Public Safety, Bland failed to signal that she was changing lanes so a trooper pulled her over. The trooper was going to give her a written warning but Bland became argumentative and uncooperative, officials say. ….

The stop escalated over a cigarette, according to the family’s lawyer, Cannon Lambert:

Lambert, citing what he had seen on the dashcam video, said the trooper then asked Bland to put out her cigarette.

Bland, who seemed irritated at having been pulled over in the first place, responded: ‘Why do I have to put out a cigarette when I’m in my own car?’” Lambert said. “And that seemed to irritate him to the point where he said, ‘Get out of the car.’”

Bland, a civil rights advocate who had moved to the Houston area from suburban Chicago for a new job at Prairie View A&M University, “wasn’t comfortable getting out of the car,” Lambert said. So the trooper “looked to force her to get out of the car by way of opening the door and started demanding that she do,” Lambert said.”

What a driving record. Not only did this toolbag have a a DWI conviction, she was speeding 15-20 over the limit while drunk. She had a previous DWI charge, but she got that dismissed when she pled to the the possession charge. So this idiot likes to drive around drunk and without insurance. At the time of her death she still owed over 7K in court fines. Look at this driving record. She probably lied about her record to get the job (drug conviction, dwi conviction) and was worried this was all going to come out as a result of the latest arrest. That’s my speculation.

Exactly why should she have put out her cigarette, while she was sitting in her own car? What authority did the trooper have to force her to do so?
In a press conference late Tuesday, the director of the Texas Department of Public Safety said that Encinia failed to “maintain professionalism” throughout his interaction with Bland, and that he has been taken off the street and placed on administrative duty for duration of the investigation into Bland’s death. In answer to a reporter’s question, Texas state Sen. Royce West said that the dash cam footage showed that Bland should not have been taken into police custody.

I read that already. The trooper probably had no authority to force her to put out her cigarette, but when you get pulled over by the cops it’s never a good idea to challenge their authority or provoke a confrontation. The best thing to do is comply and deal with any issues at a later date in the court house or by filing a complaint letter with the police. And how did Sandra Bland’s refusal help her out? She went from a warning to sitting in a jail cell with a criminal charge. That is called a pyrrhic victory.

I’ve been pulled over for traffic violations and drove away without a ticket many times because I know how to deal with the police. Sandra Bland was about to drive away without a ticket before she decided to challenge the cop. You will never win that battle except maybe later in a courtroom, never on the side of the road. I suppose if the cop beats the crap out of you then you can sue and get a nice judgment if you’re lucky.

So maybe Sandra had a right to smoke her cigarette. And what did that get her? Was it worth getting locked up for her right to smoke a butt with the cop present?

I will never defend a cop who acts wrongfully. I detest those who exercise their authority over others in a wrongful manner because I’ve been subjected to it myself. But I also live in the real world and I don’t pick fights with the cops during a traffic stop. That is for idiots.

This is how I avoid a ticket after getting pulled over.

I immediately grab my documents and place them in my left hand. Then I roll down the driver’s side window and I keep both hands on the wheel with the documents in my left hand. When a cop walks up on you he has no idea if you are going to shoot him in the face and that is always in the back of his mind. What I’m doing is showing my hands and my docs so when the cop gets to the window that is rolled down he can see that he is not in danger of being killed. This puts him at ease. I refer to the cop as “officer” and I speak in a respectful manner. I don’t try and bs him because they hear that all day long. A little honesty and remorse will go a long way. This has gotten me off many times. One time I even had a small bag of pot in the car and the cop could smell it. He started looking around the vehicle with his flashlight and asked me about the smell. I said it must be the jalapeno poppers as I was heading back from picking up food. He let me go. That was a close one. Good luck out there!

I recently had a client who was pulled over for driving while talking on a cell phone. She was actually eating a sandwich. After being pulled over, she lit a cigarette and then flicked the ashes out the window. I believe the charge for that one was littering. I do remember the statute specifically says “ashes” and the maximum fine is $2000.00. Another good reason not to smoke after being pulled over. My client did not react well to this situation and ended up being taken to the hospital in an ambulance because she had some kind of nervous breakdown type of thing. She later filed a complaint against the officers and that could have made my life more difficult, but I got her a killer deal and sold her on taking the deal so there was no cop involvement at the court house.

I sure never said anyone deserves to be arrested for “being combative” or that a “bad attitude” is a “legitimate cause for arrest”. I hope I said that being combative and having a bad attitude greatly increases your odds of being arrested!

Does it really matter if you deserve it or not once you’ve been arrested? At that point you’re already out a bunch of time and money even if you beat the charges. Maybe you’ll get raped by a cop. It happens. I imagine Sandra’s family warned her about what the cops can do when she was growing up. That’s why when they pull you over for a traffic ticket you don’t act like an asshole. It’s called self preservation. In fact, we don’t know if she’s been murdered or not yet.

To contend that during a police stop in a free society a citizen’s first thought and indeed primary concern should be about “self preservation” is jaw-droppingly absurd. The police are paid, trained professionals and ABSOLUTELY NO ONE should need to be concerned about being beaten, raped, or murdered when dealing with them—that’s classic bullshit victim-blaming at its most egregious.

If a cop’s mental state is so fragile or his fear of the public so great that he might maim or kill in the normal course of his duties, then he shouldn’t be on the street carrying a badge & gun. To assert otherwise is to not only condone, but also help perpetuate such behavior.

Not only that but the police are the state, which is the government.

At what point is it required that citizens give up their 1st Amendment Freedom of Speech (whether they have an attitude or not) rights in stating their displeasure with the government, as represented by this thoroughly unprofessional police officer?

If I was pulled over for something as stupid as improper lane change because a cop was on my ass - pulling over being something we are supposed to do - I would have been livid, and this white 54 year old woman would have giving him shit, too.

And I bet that I would not have been arrested for it.
