You shouldn’t be surprised. He is a principal witness. Unless, of course, you subscribe to the theory that the purpose of a grand jury is only to indict ham sandwiches and not determine if there is probable cause to go to trial. It will be interesting to see what the results of the grand jury’s determination on this matter might be. They were an existing grand jury and not selected particularly for this investigation. Three are black and the rest, I believe, are white. A no bill along racial lines will be about the worst case scenario.
