We have laws that limit what one would call “religious practices”. One example might by polygamy. They’re prosecuted on face value with regards to the practical application of the law. Polygamy for example wouldn’t be considered a seditious act no matter how much people would consider it a threat “to the moral foundation and the future of America”. The same is true with whatever Sharia practice that may run counter to American laws. The whole notion of Gaffney’s “brain fart” is beyond absurd.
