This is an interesting concept, but like abortion and the right to privacy, I’m not sure this is one of those things where the dog really wants to catch the tire. If they were to strike down the Administrative Procedures Act as unconstitutional, it would absolutely devastate the contours of modern government. It would, among other things, drastically increase the case load of the courts (something that I suspect the justices really don’t want); it would weaken the presidency (all administrative agencies are part of the executive branch); and it would make legislating nearly impossible.

This is the problem with stupid, simpleminded people. They don’t think beyond the immediate. Right now, Republicans are shovelling all kinds of privileges to the next Democratic President just to protect Trump TODAY.
