The full appeals court will almost certainly overrule this. It won’t have to go to the Supremes. This was a little temper tantrum by a couple of Republican judges who wanted to vent some spleen. Judges used to be kind of embarrassed to make rulings that were plainly inconsistent with the statute and previous holdings, but apparently they have been emboldened by certain Supremes’ lack of shame.
