I don’t know how they get past the fact he kept his knee on his neck for a full 2 minutes after they checked him for a pulse and couldn’t find one.

They’ll probably shop for an expert witness willing to take the stand and say that his pulse may have become so weak/irregular as to be imperceptible through the wrist, but still there and thus impossible to tell if he died as a result of the hold or aggravation of an “underlying condition.”
