If someone is racist, they’re no longer protected by the law? What?
Actually I see the point he’s trying to make. It’s hitting on the intent and as a result damaging the ‘rightful presence’ requirement of clause three. It’s an attempt to establish an intent, coincidentally pushing this into premeditated territory.
I don’t think it would be enough by itself, but it’s a stone for that pathway if enough others can be found.
