There’s another issue that they haven’t quite figured out how to deal with. In short: what is the legal theory to declare a recognized constitutional right no longer a recognized constitutionally protected right?

The only way they can really overturn Roe is by saying that the 14th Amendment’s due process clause attaches at conception. They can’t really return the issue to the states as they say they’d want to. There’s just no logic that gets you there. And even if you could create one, that is a pandora’s box of legal trouble.
