White House lawyers say it’s improper for Congress to investigate the president’s conduct when the Justice Department has already investigated him
- there is no double jeopardy to ‘investigation’
- until congress gets the entire report and supporting dox, it has no way to evaluate the investigation
- there is no prohibition about extending an investigation into areas/conduct it didnt cover (by choice or by scope limitations of the original order)
- p.s. - yesterday they said in court that congress virtually couldnt investigate the president for ‘criminal wrongdoing’ at all
- finally, white house lawyers are not the arbiter of what congressional power is (and limits are)
