That feels like a slam dunk lawsuit for anyone at the receiving end of such a discharge.

Military personnel may not sue the government. (Amongst other things, that prevents disorder within the ranks.)

A person who feels they were unjustly discharged can make an appeal to the review board of the appropriate service to fix/correct/protest a discharge.

The likely outcome (after a very long wait) would be that a person would have his or her discharge changed to Honorable/Convenience of the Government.
