Seems like Trump is at a major risk of violating a basic rule of appellate strategy—don’t take a case with bad facts that will, in turn, create bad law.

It would be ruled the same way as Gore v Bush — that it doesn’t apply to anyone else or any other situation— because this court will rule the opposite way once a Democrat is in office.
