The weapon wasn’t capable of actually killing someone. Thus an attempted murder charge is in my opinion legally inappropriate. This is not an attempt by my to justify or minimize the bigot’s actions, but rather my belief that the charge must fit the crime.

Even a halfway decent pellet rifle can easily kill a person depending on where the shot hits. Hell, my old Sheridan could put a pellet through a heavy oak wall (it’s an old pump and has dick for range).
