There realistically is nothing for them to rule upon. Kelly’s lawsuit involved an amendment to the PA constitution, which is a state-level issue upon which the highest state court ruled. And that court’s ruling is that the PA GOP cannot wait until the amendment fucks them over before choosing to challenge its constitutionality.

The only other “pending” lawsuit in PA is the one where the only thing being appealed is the state judge not allowing the filing of an amended complaint. They even spelled out in their appeal to the Third Circuit that they’re not alleging “fraud.”

In the latter, the most the USSC bench could do is send it back down to the lower courts with an order to allow the amended filing. As for the former, there is no way they could swing a ruling in Kelly’s favor without taking a massive (and very public) shit on the idea of “states rights.”
