This probably means they’re going to issue a longer reasoned decision and treat the lower court’s stay as an injunction instead of as the TRO is was intended to be. Not a great sign since, if I understand the procedure correctly, this would mean there’s never going to be a full discovery process that might lead to even more evidence that the ban was driven by animus.

To be fair no matter what they do it’s going to the Supreme Court next so they’re probably writing their decision with that outcome in mind instead of issuing a narrow ruling for the trial court to implement. It’s just going to suck though if we don’t get a full trial to begin with so that a concrete factual record can be established.
