He’s not nominating someone to be Sec Def. He’s naming an acting Sec. Def., so as to avoid the confirmation process.

I think I just hit on the wording I want for nominations: If the president does not presenta nominee for confirmation within 60 days of a vacancy, then the Senate shall select a nominee for consideration.
