Just because the defense is using mistrial as a strategy doesn’t mean they’ll get it. The prosecution has been more than obsequious to the judge in this case and he doesn’t have grounds (yet) to declare his court a mess.
What this says is that having Kyle take the stand was a mistake and the defense attorneys know it. He’s about as sympathetic a presence as your garden variety thug, and an un-tailored suit doesn’t change that about his appearance in the slightest.
I think the jury will convict and the judge will be lenient.
