So the emerging Trump defense is “They said I could have them.” Yeah, no lawyer worth his salt is gonna be able to float that to a jury. Even if the documents he hauled out of the White House are not clearly marked as classified, they still fall under laws regarding the preservation and archiving of federal documents. If the Feds knew the documents were declassified and were not subject to federal law, then they wouldn’t have asked him to put a different lock on the door as they continued to negotiate for their return.
Well, it’s almost as if he flaunted the law like he was above it!
