These would arguably be death penalty cases, as a cop (and not a co-conspirator) was killed in the crime. Even if you’re the getaway driver for a bank robbery and a guard gets killed by your buddies, it’s on you. However, I’m pretty sure the federal death penalty is going away again Day 1 of the Biden administration.
