If it’s an illegal act of tax sheltering it would fit under that category. But legal tax sheltering is simply not tax evasion. The IRA we can’t prove anything for or against since we have no proof otherwise. So right now saying that Mitt Romney “cheated” is a negative which can’t be proven or unproven.
