Not a US ctizens rights, but the courts already gave them some very basic rights like Habeas Corpus.

They'll be tried in U.S. Federal courts, take it to the bank, where most of the evidence will be inadmissible because of the way it was obtained or for national security reasons. It's already being contemplated that Khalid Sheikh Mohammed, facing death before a military tribunal for 9/11, won't be tried for that once he hits U.S. soil because the evidence was obtained by "torture" (waterboarding).

/instead, he's going to be tried on existing criminal charges for his role in the 1993 WTC bombing
