Which is still enough time to recognize that it’s not a gun, while you’re taking it out of the pocket and turning the camera on.

The time between he raises his hand and is shot is a couple of seconds (he did catch the cop unaware), but it is enough to recognize whether it’s an phone or a gun. Moreover, he seems to have some light which is directed down at the road, not at the cop, which could his phone in his other hand.
