Democrats should take the olive branch… and then proceed to pack the courts anyway. Because the GOP have completely fucked comity and don’t care about anything else except their power. Democrats should commit to restoring balance and undoing the damage Trump and McConnell have done, especially with the judiciary.

I’m on the record as saying that we should expand the Supreme Court. I think one Justice per Circuit makes sense. That’s 13 seats if you count the DC Circuit and the Federal Circuit as separate (also, interesting side question on DC statehood, what becomes of the DC Circuit?). So, 4 new seats - the easiest way to sell it is that you add one seat per year over four years, with a presidential election in the middle (2023, 2024, 2025 and 2026).

The lower courts also need to be expanded, but that’s probably an easier sell than the Supreme Court because most people don’t know much about the lower courts. But I think any court expansion/reform needs to include a major revision of the Federal Arbitration Act by allowing appeals of arbitration awards and/or striking binding arbitration.
