I think that is not worded correctly. For a nominee to fail, 1 Republican has to vote against, 3 abstain from voting. Or 2 against, 2 abstain. 3 against and 1 abstain, and it is all over, no seating of a new judge. Iโm assuming the two โindependentsโ vote with the Dems as they normally do.
Itโs 50% + 1, not 50 + 1
1 no, 3 abstain = 49Y-48N (50% + 1) Nominee confirmed
2 no, 2 abstain = 49Y-49N - VP breaks tie (50% + 1) Nominee confirmed
3 no, 1 abstain = 49Y-50N - nomination rejected
And, yes, that assumes all 45 Dems & 2 Inds are present and vote No (Looking at you Manchin)
