I was reading somewhere that if the Senate Judiciary Committee ties on the nomination it would need 60 votes to make it onto the Senate floor. But I have not yet been down the arcane Senate procedural rules rabbit-hole to verify.
AHa! Here we are:
Everyone is buzzing over Justice Breyer’s retirement. But a note of warning re process: the power-sharing agreement could gum up the nomination in a big way if it’s an 11-11 tie in Judiciary. That forces a discharge petition—a pocket 60-vote requirement. https://t.co/bLrH7g2TP5
