The problem is, that image might not be infringement. It’s not merchandise or commercial; in fact, the argument could be made for it to be fair use, as a fan art work. Copyright law in the US is so fucked up that it’s entirely plausible, and in fact somewhat likely, that this image is completely legal - but it would cost Marvel a lot of money to find that out, and they’d probably rather sweep it under the rug.
