My understanding is, it’s a normal civil lawsuit. Someone makes an accusation, the defense has to show up, if it survives a 12(b)(6) motion to dismiss (plaintiff has to show likelihood of success on the merits), it goes to discovery, in which case, yes, they would have to produce medical records, etc. Upon receiving a judgment in their favor, if it goes that far, plaintiffs would automatically be awarded attorney’s fees and a $10,000 cash judgment.

Then sue all the Texas GOP state legislators; let’s see how they like their wives, daughters and girlfriends medical records having to be opened up for public review.
