Unpopular opinion: he should get to keep his advance. Serves S&S right for not looking into him sufficiently. Those videos didn’t just appear.
Contract law is Contract law. Violating it gets the plaintiff triple damages. So S&S is bound to the letter of the Contract, no more no less.
Hopefully, and this is probably true, the advance was spaced over the production of the book and they are saving $200,000 or so by terminating the Contract now.
