Of course I think once you declare yourself openly as an enemy of the nation, then that changes things. I am not comfortable with the president being able to make that call all on his lonesome though. At the least there should be some due process to determine a US citizen is indeed an enemy combatant.

Well, being in an enemy command post and directing operations does make one an enemy combatant. Times have changed. In the past just being in a Japanese pillbox firing at American soldiers didn’t require presidential approval for troops to return fire. today these decisions come straight from the top.
